“I also from time to time get the ratings for the whole week and I can see what’s going on in these networks for the entire week.

“And this is just an example of what goes on: Nobody has reported this, and nobody will because my name’s not Rachel Maddow.

In a statement issued right after executives from Facebook and Twitter finished testifying before the Senate Intelligence Committee, the Department of Justice (DOJ) also suggested that the platforms were running afoul of antitrust laws.

“The Attorney General has convened a meeting with a number of state attorneys general this month to discuss a growing concern that these companies may be hurting competition and intentionally stifling the free exchange of ideas on their platforms,” DOJ spokesman Devin O’Malley said in a statement issued near the end of the congressional hearing.

President Trump and conservative House Republicans have repeatedly aired complaints about bias against conservatives on Facebook, Twitter, Google and other social media platforms. Those companies though have denied censoring conservative speech.

Twitter CEO Jack Dorsey and Facebook Chief Operating Officer Sheryl Sandberg testified before the Senate Intelligence Committee on Wednesday morning on efforts to combat foreign influence operations on their platforms.

Dorsey will face a second grilling later Wednesday from lawmakers in the House Energy and Commerce Committee, where he is expected to face questions on the allegations of conservative censorship.

The DOJ's move is the first sign of the administration taking concrete action to address alleged bias following President Trump's public accusations against tech companies last week

CNN Legal Setback Points to Tougher Times Ahead for Media Companies...

CNN may still be enjoying its courtroom victory last month saving White House correspondent Jim Acosta's press pass, but as far as the First Amendment goes, the television news network better be ready to play some defense. That's because on Friday, CNN suffered a bruising loss in an important appeal that will at the very least make it easier to sue the media in federal court in a handful of states including Georgia, where CNN is headquartered.

The appeal arises from a series of reports in June 2015 on the infant mortality rate for open-heart surgery at West Palm Beach, Florida-based St. Mary's Medical Center. That series, showcased on Anderson Cooper's show, asserted that St. Mary's "death rate" was three times the national average — prompting defamation lawsuits, including from David Carbone, formerly the chief executive at the hospital until he was forced to resign upon CNN's report. Carbone alleges that CNN made an unfair comparison to hospitals that did both open-heart and closed-heart surgeries, and that a more proper comparison would be adjusted for risk.

CNN contends that Carbone can't meet the "of and concerning" standard of a defamation suit because the report didn't mention him by name, and further argues that an academic disagreement about methodology can't support a defamation claim and that its chosen methodology comparing mortality rates constitutes non-actionable opinion.

However, the specific arguments for the deficiency of Carbone's claims have taken a back seat to the standard by which a Georgia federal judge had to decide whether the case should move past an initial dismissal motion.

. . . Before Kavanaugh was confirmed to be the newest associate justice at the high court, he authored an opinion for the D.C. Circuit that also expressed skepticism about the federal judge's use of SLAPP laws. In fact, after acknowledging how most sister circuits have come to a different conclusion to the issue at hand, Pryor (himself on Trump's shortlist for the Supreme Court) nods to Kavanaugh's "far more convincing" 2014 opinion in Abbas v. Foreign Policy Group.

Should CNN take its case to the Supreme Court — and lose — that would mean no more use of SLAPP laws in federal court nationwide, a prospect that could scare off any petition for writ of certiorari. Then again, even if CNN gets risk-adverse, there will likely be others who someday take the issue to the high court. For example, Daniels' attorney Michael Avenatti will be looking to overturn the recent decision in favor of Trump by appealing the issue of whether Texas SLAPP statute had any business in a California court.

Here Are The Most Egregious Fake News Stories Of 2018

As 2018 comes to a close, it’s time to review the year’s worst cases of media misquotes, misleading narratives, major corrections and straight-up fake news.

While last year’s fake reporting largely occurred during the media’s relentless pursuit to prove Russian collusion, this year’s list is much more varied. However, some themes emerged: stories about then-Supreme Court nominee Brett Kavanaugh and the U.S. border were routinely flagged for misinformation.

Without further ado, here is the list of 2018’s worst examples of fake news:

1. WaPo Blames Border Patrol For Death of 7-Year-Old Migrant

The Washington Post published a story in December focusing on a 7-year-old migrant child from Guatemala who died in border patrol custody.

2. CNN And The Hill Spread Retracted Sexual Assault Claim Against Kavanaugh

CNN and The Hill both reported on a sexual assault claim against Supreme Court nominee Brett Kavanaugh in late September without ever mentioning that the claim had been quickly retracted...

3. Boston Globe Corrects Liz Warren Story — Makes Her Less Native American

Democratic Massachusetts Sen. Elizabeth Warren released a DNA test in October seeking to prove her repeated claims that she has Native American ancestry.

4. NYT Accuses Nikki Haley Of Purchasing Expensive Curtains

The New York Times initially tied U.S. Ambassador to the UN Nikki Haley to expensive curtains hanging in the ambassador’s apartment in New York, writing, “Nikki Haley’s View of New York Is Priceless. Her Curtains? $52,701.”

5. Media Still Blaming Republicans For Steele Dossier

CNN’s Jim Sciutto, MSNBC’s Katy Tur, and MSNBC’s Ari Melber were all responsible for falsely claiming that Never-Trump Republicans were responsible for initial funding of the salacious Steele dossier.

While NBC’s story is not incorrect, its choice to sit on evidence that contradicted a serious sexual assault allegation against Supreme Court nominee Brett Kavanaugh earned them a spot on this list.

Celebrity porn lawyer Michael Avenatti claimed he knew a second woman who could back up gang rape allegations made against Kavanaugh by his client, Julie Swetnick.

That second woman actually contradicted the allegations in a phone interview with NBC News on September 30. Mysteriously, NBC chose not to publish this information until weeks later and after Kavanaugh had already been confirmed to the Supreme Court.\

10. McClatchy Claims Mueller Has Evidence That Corroborates Piece Of Dossier

McClatchy reported in April that special counsel Robert Mueller had evidence that former Trump attorney Michael Cohen had been in Prague in the summer of 2016. The report appeared to corroborate a key part of the largely unverified Steele dossier.

#JOURNALISM: The media’s “Gotcha!” hysteria is shameful

While BuzzFeed alone created the false report, which was based, naturally, on anonymous sources, it was not alone in revealing its desire to be rid of Trump. Much of the political class embraced the story without doubts because they wanted it to be true. Dems in Congress instantly pledged investigations.

Then there are the so-called journalists who swallowed the ­report without trying to confirm it themselves. Many touted it as the Holy Grail while inserting the ridiculous phrase, “if it’s true.”

Not so long ago, no respected journalist or news organization would go public with something unless they had enough evidence to reach the conclusion it was true. The bigger the story, the higher the threshold of necessary evidence.

Not Friday. Then the biggest possible story was presented with the least possible evidence. “If it’s true” is an admission of malpractice.
